FAMILY LAW

Petition for Divorce, Legal Separation or Annulment

  • To start an action for divorce, legal separation or annulment.

Joint Petition for Divorce Legal Separation or Annulment 

  • To jointly start an action for divorce, legal separation or annulment. A joint petition, which is used when both parties are filing for divorce together, must be signed by both parties and is not required to be served upon either party after being filed with the court.

Motion for Modification of Legal Custody and or Physical Placement

  • To give notice to another party that a request is being made to change a current order concerning legal custody (major decision making) and/or physical placement (when the child is with each party).

Motion for Modification of Child Support

  • To give notice to another party that a request is being made to change a current order concerning child support.

Petition to Establish Third Party Legal Custody

  • To start an action for third party legal custody by someone other than the child’s parent(s).

Waiver and Consent to Petition for Third Party Legal Custody

  • To be used by a parent to waive notice and agree with the petition to establish third party legal custody.

Notice of Intent to Remove Child(ren)

  • To give notice to the other parent of intent to (1) establish a legal residence with the child at any location outside the State of Wisconsin, (2) establish a legal residence with the child at any location within the State of Wisconsin that is at a distance of 150 miles or more from the other parent, or (3) remove the child from the State of Wisconsin for more than 90 consecutive days.

Motion for Visitation Rights

  • To give notice that a grandparent, great-grandparent, stepparent, or person who has maintained a relationship similar to a grandparent-child is seeking reasonable visitation rights.

Motion for Contempt

  • To give notice to another party that a request is being made to find that party in contempt for violations of a current court order.

Motion to Enforce Physical Placement Order

  • To allow a parent who has been awarded periods of physical placement to seek enforcement of a physical placement order.

Stipulation and Order

  • Allows parties to reach an agreement to certain modifications of a Family Court order for legal custody, physical placement and child support issues.

 

CHILDREN’S CODE

Motion to Change Placement

  • Request to the court to enter an order changing the child’s placement.

Motion to Revise Dispositional Order

  • Request to the court to enter an order revising the CHIPS dispositional order.

Motion to Extend Dispositional Order

  • Request to the court to enter an order extending the CHIPS dispositional order.

Motion to Extend Consent Decree

  • Request to the court to enter an order extending a consent decree.

Motion to Vacate Consent Decree

  • Request to the court to enter an order vacating a consent decree.

Petition for Appointment of Guardian

  • To initiate a proceeding to appoint a guardian for a person under the age of 18.
    • Child must be under a child in need of protection or services (CHIPS) order or a CHIPS petition must have been filed.
    • May be filed by the (1) child, (2) child’s GAL, (3) child’s parent, (4) person with whom the child is placed or in whose home placement of the child is recommended by the ICW Department, or (5) the ICW Department.

Motion to Revise Guardianship Order

  • Request to the court to enter an order revising the guardianship order.

Motion to Terminate Guardianship Order

  • Request to the court to enter an order terminating the guardianship order.

Stepparent Adoption Packet

  • To initiate a stepparent adoption action.

Petition for Adoption

  • To initiate a proceeding for the adoption of a child.
    • May be filed by (1) a married adult couple, (2) either spouse if the other spouse is a parent of the child,  (3) an unmarried adult, or (4) the ICW Department.

  • A request that the Judiciary assign a judge to officiate a marriage ceremony.

  • A request that may be used by a party seeking to file a petition or motion without paying a filing fee.
