Oneida files for Preliminary Injunction on Hobart

(Oneida Reservation) – The Oneida Nation has filed for legal action to prohibit the Village of Hobart from citing the Nation for failure to obtain a Hobart Event Permit. Hobart’s Attorney sent a letter threatening to impose penalties upon the Nation, its officials, and employees responsible for the conduct of Big Apple Fest unless the Nation takes steps by 4:00 PM on Friday September 9th to comply with Hobart’s Special Events Ordinance. The event takes place entirely within the reservation boundaries and on trust land. Hobart has no authority to regulate the Nation or its officials or activity on the Oneida Reservation or on the Nation’s trust lands. Oneida has laws and ordinances in place to ensure public safety and welfare.

The Oneida Nation intends to continue with the event as it has occurred in the past six years. The Big Apple Fest is a growing community event that is in compliance with all Oneida Nation laws and ordinances. This event is family oriented and the Oneida Nation provides a safe and healthy environment. The Oneida Police Department works in cooperation with other law enforcement agencies and the Oneida Health Center provides a first aid safety station.
